1. Acceptance of Terms
By creating an account or using Braincave, you agree to these Terms of Service. If you do not agree, please do not use the service.
2. Service Description
Braincave is a personal second brain application that captures, organises, and surfaces information using AI. The service includes text, voice, image, and email capture; AI-powered classification and tagging; daily digests and smart nudges; and natural language search across your personal data.
3. Your Account
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
- You must be at least 16 years old to use Braincave
- One person per account. Accounts are not transferable
4. Acceptable Use
You agree not to:
- Use Braincave for any illegal purpose
- Upload content that infringes on others' intellectual property
- Attempt to access other users' data or accounts
- Use automated tools to scrape or overload the service
- Resell, redistribute, or sublicense Braincave
5. Your Content
You retain full ownership of everything you capture in Braincave. We do not claim any intellectual property rights over your content. We access your content only to provide the service (AI processing, storage, and retrieval) and as described in our Privacy Policy.
6. Payment and Billing
- Braincave Standard costs $10/month (or local currency equivalent)
- Braincave Big Brain costs $15/month with unlimited captures and searches
- Founding Members pay $5/month, locked in permanently (first 100 users)
- All plans include a 14-day free trial. A credit card is required to start a trial
- Payments are processed securely through our payment provider
- Prices may change with 30 days' notice for new subscribers
7. Cancellation and Refunds
- You can cancel your subscription at any time from your account settings
- Cancellation takes effect at the end of your current billing period
- We do not offer refunds for partial billing periods
- After cancellation, you can export your data before your account is closed
8. Service Availability
We strive to keep Braincave available 24/7, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will endeavour to provide advance notice for planned maintenance.
9. Limitation of Liability
Braincave is provided 'as is' without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
11. Governing Law
These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.
